By registering for or using the MoyaLinked platform ("Service"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service.
These Terms constitute a legally binding agreement between you and MoyaLinked. We may update these Terms from time to time; continued use of the Service after changes are published constitutes acceptance of the revised Terms.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in order to create an account. By registering, you confirm that all information you provide is accurate and up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at legal@moyalinked.app if you suspect any unauthorised access to your account.
MoyaLinked grants you a limited, non-exclusive, non-transferable licence to access and use the Service for your legitimate business purposes, subject to these Terms.

Violation of this section may result in immediate suspension or termination of your account without notice.
You retain ownership of all data, contacts, conversations, and content you upload to or generate within the Service ("Your Data"). By using the Service, you grant MoyaLinked a limited licence to process Your Data solely to provide and improve the Service.
You are solely responsible for ensuring that Your Data is accurate, lawfully obtained, and does not infringe any third party's rights. You confirm that you have obtained all necessary consents to store and process contact information within MoyaLinked in compliance with POPIA and any other applicable data-protection laws.

MoyaLinked integrates with the Meta WhatsApp Business API. Your use of this integration is also governed by Meta's Terms of Service and WhatsApp Business Policy. You are responsible for ensuring that your WhatsApp Business Account is in good standing with Meta and that all message templates and broadcast campaigns comply with Meta's policies.
MoyaLinked is not liable for any suspension, restriction, or termination of your WhatsApp Business Account by Meta.
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
We will endeavour to provide reasonable advance notice of any material changes that may affect your use of the Service.
Certain plans require a paid subscription. Fees are displayed on our Pricing page and are charged in South African Rand (ZAR) unless otherwise stated. All fees are exclusive of any applicable taxes.
Refunds are considered on a case-by-case basis and are only issued where there has been a material failure of the Service on our part. Message costs charged by Meta are non-refundable.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be free from errors, viruses, or other harmful components.
To the fullest extent permitted by applicable law, MoyaLinked and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to MoyaLinked in the three (3) months preceding the event giving rise to the claim.
You may cancel your account at any time through the account settings. Upon cancellation, your access to the Service will cease at the end of your current billing period.
We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms, if your account is used for fraudulent or illegal activity, or if we are required to do so by law.
Upon termination, we will retain Your Data for a period of 30 days, after which it will be permanently deleted. You may request an export of your data before termination by contacting legal@moyalinked.app.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
